dc.description.abstractA presente dissertação discute a possibilidade de implantação das Diretrizes Nacionais para investigar, processar e julgar com perspectiva de gênero as mortes violentas de mulheres (feminicídios) na Delegacia Especializada de Homicídios de Mulheres na cidade de Vitória, estado do Espírito Santo. As diretrizes foram redigidas em um trabalho conjunto entre a Secretaria de Políticas para Mulheres do Ministério da Mulher, da Igualdade Racial e dos Direitos Humanos e Secretaria Nacional de Segurança Pública do Ministério da Justiça, sendo o trabalho resultado do processo de adaptação do Protocolo latino-americano para investigação das mortes violentas de mulheres por razões de gênero (femicídio/feminicídio) redigido pelo Escritório Regional para a América Central do Alto Comissariado das Nações Unidas para os Direitos Humanos (OACNUDH), com o apoio do Escritório Regional para as Américas e o Caribe da Entidade das Nações Unidas para a Igualdade de Gênero e o Empoderamento das Mulheres (ONU Mulheres), no marco da Campanha do Secretário-Geral das Nações Unidas pelo fim da violência contra as mulheres. Discute-se, a partir da análise de dois Inquéritos Policiais instaurados pela Delegacia de Homicídios e Proteção a Mulher na cidade de Vitória/ES, versando sobre casos de feminicídios em que medida as Diretrizes possibilitará uma melhor investigação, especialmente no Estado do Espírito Santo, cuja taxa de feminicídios é uma das mais altas do país. Após a aplicação simulada das Diretrizes em tais Inquéritos, foi possível identificar dois tipos de feminicídios, o primeiro como feminicídio íntimo e o segundo como feminicídio íntimo sexual, possibilitando a tipificação penal da qualificadora do feminicídio, que até então ficavam diluídos no tipo penal homicídio.pt_BR

dc.description.resumoThis dissertation discusses the possibility of implementing the National Guidelines to investigate, prosecute and judge from a gender perspective the violent deaths of women (femicides) at the Specialized Homicide Office for Women in the city of Vitória, state of Espírito Santo. The guidelines were drafted in a joint effort between the Secretariat for Women's Policies of the Ministry of Women, Racial Equality and Human Rights and the National Secretariat of Public Security of the Ministry of Justice, the work being the result of the adaptation process of the Latin American Protocol For the investigation of violent deaths of women on the basis of gender (femicide/femicide) drawn up by the Regional Office for Central America of the United Nations High Commissioner for Human Rights (OACNUDH), with the support of the Regional Office for the Americas and the Caribbean Of the United Nations Entity for Gender Equality and the Empowerment of Women (ONU Women), within the framework of the United Nations Secretary-General's Campaign to end violence against women. It is discussed, based on the analysis of two police investigations instituted by the Homicide and Protection of Women's Office in the city of Vitória / ES, dealing with cases of femicide to what extent the Guidelines will enable a better investigation, especially in the State of Espírito Santo, Whose rate of feminicide is one of the highest in the country. After the simulated application of the Guidelines in such Inquiries, it was possible to identify two types of feminicides, the first as intimate feminicide and the second as intimate sexual feminicide, making possible the criminalization of the qualifier of feminicide, which until then were diluted in the homicide criminal type.pt_BR
