dc.description.abstract	presente estudo objetiva analisar se, após o julgamento do habeas corpus nº 143.641 pelo Supremo Tribunal Feral, o Poder Judiciário do Estado do Espírito Santo tem dado efetividade à garantia da conversão da prisão preventiva em segregação domiciliar a gestantes e mulheres com filho de até 12 (doze) anos de idade incompleto. Busca-se proceder ainda um exame quanto aos reflexos atinentes aos infantes que tem a convivência com seus genitores suprimidas, examinando as consequências afetivas, sociais e cognitivas no desenvolvimento da criança, lançando um olhar, não só mais a infração praticada, mas também no tocante a manutenção e fortalecimento vínculo mãe-filho, bem como na construção da maternidade a ser exercida por este agente com a finalidade de implementação de política pública que atue de forma preventiva nos crescentes índices de criminalidade. A partir desse quadro, foram catalogadas as decisões proferidas pela Corte Estadual Capixaba entre o período de 20 de fevereiro de 2018 a 1º de janeiro de 2021, procedendo a uma análise qualitativa, ao examinar o teor do julgamento proferido, e quantitativa, ao observar numericamente o montante de benefícios garantidos. O exame do total de 473 acódãos permitiu concluir que, malgrado a Suprema Corte tenha fixado como regra o emprego da prisão domiciliar frente ao público-alvo analisado, tal benefício encontra ainda grande resistência pelos aplicadores do direito que, baseando-se na vontade do intérprete, põem em segundo plano os limites semânticos do texto.	pt_BR

dc.description.resumo	The present study aims to analyze whether, after the judgment of habeas corpus nº 143.641 by the Supreme Feral Court, the Judiciary of the State of Espírito Santo has been effective in guaranteeing the conversion of preventive detention into home segregation for pregnant women and women with children up to 12 years old. (twelve) years of age incomplete. It also seeks to carry out an examination as to the reflexes related to the infants who live with their suppressed parents, examining the affective, social and cognitive consequences on the child's development, taking a look, not only at the infraction, but also in terms of the maintenance and strengthening of the motherchild bond, as well as in the construction of maternity to be exercised by this agent with the purpose of implementing public policy that acts in a preventive way in the increasing crime rates. Based on this table, the decisions handed down by the State Court of Capixaba between the period of February 20, 2018 to January 1, 2021 were cataloged, proceeding to a qualitative analysis, when examining the content of the judgment given, and quantitative, when observing numerically the amount of guaranteed benefits. The examination of the total of 473 cases allowed to conclude that, in spite of the Supreme Court having established as a rule the use of house arrest in front of the target audience analyzed, this benefit still finds great resistance by the enforcers of the law, who, based on the will of the interpreter, they put the semantic limits of the text in the background.	pt_BR
