dc.description.abstractComo objetivo geral, o presente estudo buscou delinear parâmetros sobre os precedentes judiciais no direito pátrio e a sua influência no ambiente da segurança pública e da atividade policial. O significativo aumento do número de invalidações processuais, especialmente em razão do reconhecimento pelo Poder Judiciário de atuações descompassadas de agentes da segurança pública com os precedentes judiciais, revela a real necessidade em pesquisar os impactos causados ao sistema de justiça criminal, bem como investigar quais caminhos e mecanismos poderiam contribuir para minimizar o problema posto. O estudo, inicialmente, analisou o âmbito da formação de um precedente judicial, lastreado como importante fonte de conhecimento do Direito, e os possíveis desdobramentos causados a um processo de natureza criminal em decorrência da inobservância por agentes de segurança pública a orientações jurisprudenciais exaradas por tribunais superiores. Partiu-se do propósito de demonstrar a dinâmica evolutiva da jurisprudência dos tribunais no país, além dos avanços que foram introduzidos em nosso ordenamento jurídico com o advento da Emenda Constitucional n. 45/2004, que fora criada para possibilitar celeridade processual, uniformidade de tratamento e, de modo especial, segurança jurídica na efetivação de decisão judiciais. O estudo observou especificamente as consequências jurídicas ocasionadas pela inobservância aos precedentes judiciais oriundos dos tribunais superiores por parte de alguns agentes dos órgãos de segurança pública indicados no artigo 144 da Constituição Federal. Para tanto, pretende-se aprofundar o estudo sobre abalizada doutrina e jurisprudência dominante – sendo esta vinculativa ou não –, os aspectos teóricos e práticos sobre a atuação de agentes de segurança pública no exercício de policiamento ostensivo e investigativo, bem como as invalidades processuais que possam originar da ausência de atenção aos precedentes judiciais firmados em Cortes superiores, com ênfase em matéria penal e processual penal. A hipótese admitida no presente estudo recai sobre a análise de possível influência da ausência de instrução e capacitação de agentes de segurança pública sobre posicionamentos jurisprudenciais que possam impactar em suas respectivas funções. O estudo, apoiado em referencial teórico composto por renomados autores sobre o tema, valeu-se de pesquisa qualitativa e quantitativa, no que se refere à frequência simples, mediante análise de acervo bibliográfico e de dados jurisprudenciais coletados dos tribunais superiores. Almeja-se, através da orientação especializada – capacitação e treinamento constantes sobre os precedentes judiciais – dar aos agentes de segurança pública condições de evitar a ocorrência de indesejadas nulidades processuais, como forma de fortalecer a efetividade do sistema de justiça criminal no país. Diante dos resultados apresentados, projeta-se na ausência de conhecimento aos precedentes judiciais a explicação pelo reconhecimento de nulidades processuais.pt_BR

dc.description.resumoAs a general objective, this study sought to outline parameters on judicial precedents in Brazilian law and its influence on the environment of public security and police activity. The significant increase in the number of procedural invalidations, especially due to the recognition by the Judiciary of the actions of public security agents out of step with the judicial precedents, reveals the real need to research the real impacts caused to the criminal justice system, as well as to investigate which ways and mechanisms could help to minimize the problem posed. The study initially analyzed the scope of the formation of a judicial precedent, backed up as an important source of knowledge of the Law, and the possible consequences caused to a criminal process as a result of the non-compliance by public security agents with jurisprudential guidelines issued by courts superiors. The purpose was to demonstrate the evolutionary dynamics of the jurisprudence of the courts in the country, in addition to the advances that were introduced in our legal system with the advent of Constitutional Amendment n. 45/2004, which was created to enable procedural speed, uniform treatment and, in particular, legal certainty in the execution of judicial decisions. The study specifically observed the legal consequences caused by the failure to comply with judicial precedents arising from the higher courts by some agents of the public security agencies indicated in article 144 of the Federal Constitution. Therefore, it is intended to deepen the study of authoritative doctrine and dominant jurisprudence - whether binding or not - the theoretical and practical aspects of the performance of public security agents in the exercise of ostensible and investigative policing, as well as the procedural invalidities that may originate from the lack of attention to the judicial precedents established in higher courts, with an emphasis on criminal matters and criminal procedure. The hypothesis accepted in this study is based on the analysis of the possible influence of the lack of instruction and training of public security agents on jurisprudential positions that may impact their respective functions. The study, supported by a theoretical framework composed by renowned authors on the subject, used qualitative and quantitative research, with regard to simple frequency, through analysis of bibliographic collection and jurisprudential data collected from higher courts. The aim is, through specialized guidance – constant training and training on judicial precedents – to provide public security agents with conditions to avoid the occurrence of unwanted procedural nullities, as a way to strengthen the effectiveness of the criminal justice system in the country. In view of the results presented, the explanation for the recognition of procedural nullities is projected in the absence of knowledge of judicial precedents.pt_BR
