dc.description.abstractA partir do século XIX, o processo acelerado de migração da região rural para as cidades brasileiras causou nas mesmas impactos de difícil solução. Utilizando uma abordagem dialética e referencial bibliográfico primário, veremos como a questão territorial urbana passou a ser pauta de estudos que envolvem a distribuição de terras que se remetem à questões que remontam ao período do descobrimento do Brasil, das Capitanias Hereditárias e das Sesmarias e ao período Pré-republicano com a Lei de Terras em 1850. Em todos esses períodos históricos, o registro cartográfico e documental das terras transferidas pela Coroa foi falho e confuso, agravando as dificuldades dos atuais gestores municipais em sua tentativa de democratizar a propriedade das terras. Em face da necessidade de se conhecer o dono primitivo da gleba, objeto de parcelamento do solo, e da lacuna bibliográfica existente sobre o assunto, desenvolvemos o tema e o conceito de “Pesquisa Fundiária”. Apresentamos, ainda, um estudo analítico comparativo entre os principais marcos jurídicos que tratam da regularização fundiária, quais sejam, as leis 11.977/2009 – Programa Minha Casa, Minha Vida (PMCMV) – e 13.465/2017, pontuando as alterações e inovações da nova lei e apontando, a partir daí, a necessidade da pesquisa fundiária. Buscando retratar de maneira descritiva e exploratória, apresentamos o estudo de caso de terrenos situados no município de Vitória – ES, que serão utilizados como base para o objetivo deste trabalho que é apresentar uma proposta metodológica para a execução de uma “Pesquisa Fundiária” que venha a subsidiar a todos os envolvidos em questões fundiárias e que busquem minimizar entraves jurídicos que dificultem a transmissão legal da propriedade de regiões ocupadas irregularmente. Concluímos que uma metodologia para a execução da pesquisa fundiária pode beneficiar a todos que busquem executar o parcelamento do solo urbano.pt_BR

dc.description.resumoFrom the 19th century, the accelerated migration process from the rural region to urban ones caused impacts that were difficult to solve over Brazilian cities. Considering a dialectical approach and a primary bibliographic reference, we will find how the territorial urban issue has become the subject of many studies involving the distribution of land related to the period of the Brazil’s discovery, the Hereditary Captaincies and the Sesmarias and the pre-Republican period with the Land Law in 1850. Throughout these historical periods, the cartographic and documentary archives of lands transferred by the Portugal Royal Court was flawed and confusing, exacerbating the difficulties of current municipal managers in their attempt to democratize the land ownership. Facing the need to know the primitive owner of a parcel of land, and the lack of information about the subject, we research about it, developed the theme and establish the concept of “Land Research”. We also present a comparative and analytical study between the main legal frameworks that deal with land regularization, namely, the laws 11.977 2009 – Program My House, My Life (PMCMV) and 13.465/2017, highlighting the changes and innovations of the new law pointing from there the need for land research. Working in a sense to portray in a descriptive and exploratory manner, we present a case study of land located in the city of Vitória – ES, which will be used as a basis for the objective of this work, which is to present a methodological proposal for the execution of a “Land Research” that could provide subsidies for all those involved in land issues who want to minimize legal obstacles related to legal transmission of property from irregularly occupied regions. We conclude that a methodology for the execution of land research can benefit everyone who wants to execute the subdivision of urban land.pt_BR
